Mini & Mae LLC – Terms of Service / AGB (EN)

Welcome to Mini & Mae. These Terms of Service (“Terms”) govern your use of our website, store, and services (together, the “Services”). By placing an order or using our Services, you agree to these Terms.

If you are a consumer in the European Union (EU), your statutory rights under EU law, including the right of withdrawal, remain unaffected. For more details, please see our Refund policy – Mini and Mae

1. Scope

  1. These Terms apply to all contracts for the sale of goods between Mini & Mae LLC (“Seller”) and consumers or businesses (“Customer”) through the Mini & Mae online store.
  2. Any customer-specific terms are excluded unless expressly agreed.
  3. Consumer: any natural person acting for purposes not related to their commercial or independent professional activity.
  4. Business: any natural or legal person acting in the exercise of commercial or professional activity.

2. Contract Formation

  1. Product descriptions in the online store are not binding offers, but invitations to submit a binding order.
  2. Customers submit an offer via the online order form, email, or contact form. The order is binding when the “Place Order” button is clicked.
  3. The Seller may accept the offer within five days by:
  • sending order confirmation via email or text; or
  • shipping the goods; or
  • requesting payment.
  • The contract is concluded at the moment the first of these occurs.
  1. Payment via PayPal, Shopify Payments, is processed by the respective provider under their terms. Order acceptance occurs when the payment is successfully submitted.
  2. The contract text is stored by the Seller and sent to the Customer by email. Customers are responsible for providing a valid email address.
  3. The contract may be concluded in English 

3. Right of Withdrawal (EU Consumers)

  1. EU consumers have a statutory 14-day right of withdrawal.
  2. Detailed instructions are provided in our Refund policy – Mini and Mae
  3. The right of withdrawal does not apply to consumers outside the EU.

4. Prices & Payment Terms

  1. Prices are in USD and include applicable US sales tax. EU customers may pay additional VAT, customs duties, or fees.
  2. Additional payment/transfer costs (e.g., bank fees, exchange rates) may apply.
  3. Accepted payment methods: PayPal, Amazon Payments, Shopify Payments (Stripe), Klarna, SOFORT, credit/debit cards.
  4. Payment is due immediately unless otherwise agreed.
  5. Seller may refuse orders if a payment provider rejects the transaction.

5. Delivery & Shipping

  1. Shipping is to the address provided by the Customer.
  2. Estimated delivery times are provided but may vary due to customs, carriers, or other delays.
  3. Risk of loss passes to the Customer upon delivery to the shipping carrier, even for EU consumers.
  4. Seller reserves the right to withdraw from the contract in case of supply issues outside the Seller’s control, with reimbursement of any payment already made.
  5. Self-collection is not possible.
  6. Gift cards are delivered via email or download.

6. Retention of Title

  1. Goods remain the property of the Seller until full payment has been received.

7. Warranty / Liability

  1. EU and US law applies as appropriate.
  2. Seller liability is limited to intent or gross negligence, except where legally prohibited.
  3. Statutory warranty rights apply for EU consumers.
  4. For businesses:
  5. Warranty period for new goods: 1 year
  6. Used goods: warranty excluded
  7. Claims do not renew if replacement is delivered
  8. Transport damages must be reported immediately.

8. Customization / Customer Content

  1. Customer provides all content (text, images, graphics) and ensures rights to use it.
  2. Customer indemnifies Seller from third-party claims arising from content use.
  3. Seller may refuse processing of content violating laws or morality.

9. Gift Cards

  1. Only redeemable in the Mini & Mae online store.
  2. Valid for three years after purchase.
  3. Can only be applied once per order and not for other gift cards.
  4. Partial use is allowed; remaining balance stays on the card.
  5. Not redeemable for cash or interest.

10. Governing Law

  1. US law governs the contract, except EU consumer rights remain unaffected.
  2. For EU consumers, statutory rights under local law are preserved.

11. Alternative Dispute Resolution (ADR)

  1. The European Commission provides a platform for Online Dispute Resolution (ODR), which is available at https://ec.europa.eu/consumers/odr.
  2. Mini & Mae LLC is not obligated and does not agree to participate in consumer arbitration or alternative dispute resolution procedures.
